Email survey prize draw terms and conditions

1. Promoter’s name and address
Xbridge Limited, trading as Simply Business, company number 03967717 with registered address at Sixth Floor, 99 Gresham Street, London EC2V 7NG (“Simply Business”. “we”, “us”)

2. Application
2.1 These terms and conditions (the “Terms and Conditions”) apply to the Simply Business email survey prize draw (the “Competition”).
2.2 By entering the Competition, you (the “Participant”, “you” or “your”) confirm that you have read and understood these Terms and Conditions and agree to be bound by them, and that you meet the eligibility requirements at Clause 5.

3. Opening and closing dates
The Competition will open on 07/02/24 (the “Opening Date”) and will close on 12/03/24 at 23:59:59 (GMT) (the “Closing Date”).

4. The winner and the prize
4.1. There will be one winner of the Competition (the “Winner”).
4.2. Subject to meeting the requirements of Clauses 5 and 6, the Winner will win a £50 gift card (the “Prize”). The Prize is non-exchangeable and non-transferable by you. We reserve the right to substitute the Prize with a prize of equal or greater value if the Prize is unavailable.

5. Eligibility and conditions of entry
5.1 You are eligible to enter the Competition if, at the time of submitting an entry to the Competition in accordance with this Clause 5 (the "Entry"), you meet the following requirements (which we may require you to evidence in order to verify your Entry):
5.1 (a) you are aged 18 or over;
5.1 (b) you are a sole trader or the business owner of an actively trading company or partnership registered in the United Kingdom (excluding Northern Ireland);you hold a business bank account that is not used for personal expenditure;
5.1 (c) and you are not a Simply Business employee or an immediate family member of a Simply Business employee.
5.2 The Competition is free to enter. To enter the competition, you must complete and submit the full survey to us through the survey link in our newsletter with all the required details between the Opening Date and the Closing Date (inclusive). You may only submit one Entry.
5.3 We reserve the right to exclude your Entry from the Competition if:
5.4 (a) it does not comply with these Terms and Conditions;
5.4 (b) it is submitted after the Closing Date;
5.4 (c) it is incomplete or illegible;
5.4 (d) it is submitted in bulk, in conjunction with other entries or parties, or on behalf of an organisation or another individual (including by an agent);
5.4 (e) it is the result automatic computer generation; or
5.4 (f) your conduct is otherwise contrary to the spirit or intention of the Competition.

6. Winner announcement
6.1 The Winner will be selected at random using a computerised process from all valid entries submitted by the Closing Date.
6.2 We will contact the Winner by email at the address provided in their Entry on or before 15/03/24 to inform them of their win, and to ask them to confirm their email address for the purpose of our delivery of the Prize. If a Winner does not confirm their details for delivery by return email within one week of request, we may void their Entry and award the Prize to another Participant.
6.3 We will deliver the Prize, together with the instructions and terms for redeeming the Prize, within 30 days of the Winner confirming their delivery details in accordance with Clause 6.2. 6.4 We are required by law to publish or make available information that indicates that a valid award took place. To meet our obligations, we shall send relevant details to individuals who request them by email at [email protected] or by letter at Social Media, Xbridge Limited, Sixth Floor, 99 Gresham Street, London EC2V 7NG (enclosing a self-addressed envelope) within one month of the Closing Date. If you do not want details of your Entry to be published or made available to others, please contact us as the email or postal address set out above. In all circumstances we may still provide details about any winning Entry to the Advertising Standards Authority directly on request.

7. Intellectual property
7.1 You hold the rights of ownership in your Entry. You grant us a non-exclusive, worldwide, irrevocable licence to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence your Entry and any accompanying materials for the purposes of making your Entry available on our website (www.simplybusiness.co.uk), in any other media and in connection with any publicity regarding the Competition.
7.2. Simply Business will own all copyright in the entry.

8. Data privacy
8.1 We will collect the content and information you submit when you participate in this Competition in order to facilitate the Competition and to manage your Entry and delivery of any Prize. See also Clause 6 above with regard to the announcement of the Winner(s).
8.2 If you opt in to receive marketing communications from us, we will also use your personal data for marketing purposes. Entrants may opt out of receiving additional marketing messages at any time.
8.3 We shall process any personal data in accordance with these Terms and Conditions and our Privacy Policy.

9. General
9.1 Any decision made by us regarding the Competition will be final and binding.
9.2 We accept no responsibility or liability for any:
9.2(a). failure of a third party (including, without limitation, any delivery provider used by us) to fulfil its contractual obligations;
9.2(b). Entry not seen or taken into account by us for technical reasons (including any Entry which is lost, damaged or delayed as a result of a network, computer hardware or software failure or internet issue), noting that we will not accept proof of submission of your Entry as proof of receipt; or
9.2(c). communications from us which are not seen or delivered as a result of a network, computer hardware or software failure, as a result of an invalid e-mail or other address provided to us, or any ‘spam’ or ‘junk mail’ filter settings (or equivalent) on your email or social media account.
9.3 Simply Business, our agents and delivery providers will not in any circumstances be responsible or liable to you for any loss, damage, personal injury or death resulting from this Competition or your acceptance of a Prize unless it is caused by the relevant party’s negligence or fraud.
9.4 We reserve the right to cancel or suspend the Competition and/or modify the Terms and Conditions at any time.
9.6 These Terms and Conditions are governed by the laws of England and Wales and any disputes arising under them or in connection to the Competition shall be subject to the exclusive jurisdiction of the English Courts.
