What is a sublease agreement?
Subletting is becoming increasingly popular, particularly in larger cities. If you want to make sure your tenant consults you before subletting your property then you need to have a sublease agreement in place. However, you can only compel your tenants to notify you if you have stipulated that they must do so in your tenancy agreement.
If you have done so, then you will need a sublease agreement for your tenants to sign should you want to allow them to do so.
You are within your rights to refuse to allow your tenants to sublet, something which can also be specified in your tenancy agreement. However, if you are happy to let them sublet but want to lay out particular terms, then a sublease agreement is the document you want.
Using the licence to sublet template
In practice, entering into a sublet arrangement is simple, but it is important that the document is properly drafted. As such, we’ve partnered with LHS Solicitors’ elXtr to offer a free sublease agreement, available as a PDF and Word document download.
The document, which you can customise to ensure that it suits your circumstances, sets out the obligations of the tenant and sub-tenant, and proves that the landlord has given permission for the tenant to sublet the property.
The template also ensures that the sub-tenant will recognise the tenant’s obligations under the lease, and will abide by them. Meanwhile it also requires that the sub-tenant not assign possession of the property to a further sub-tenant without the express permission of the landlord.
